By using the services of Digital Wallet Services (DWS) S.A.R.L, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use our services.
1. Acceptance of Terms
By creating a DWS merchant account or using any DWS service, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable Moroccan laws and regulations. These terms apply to all users of the DWS platform.
2. Service Description
DWS provides online payment processing services, digital wallet infrastructure, payment links, recurring billing, analytics, and AI-powered business solutions to Moroccan businesses. Services are subject to availability and may be modified at any time with reasonable notice.
3. Merchant Eligibility
To use DWS payment services, you must: (a) be a legally registered business in Morocco; (b) complete our KYC (Know Your Customer) verification process; (c) comply with all applicable Moroccan laws including those of Bank Al-Maghrib; (d) maintain accurate and up-to-date business information on your account.
4. KYC & Compliance
You agree to provide accurate identity and business documents as required by Moroccan financial regulations. DWS reserves the right to suspend or terminate accounts that fail to maintain compliance or provide false information. All KYC data is processed in accordance with our Privacy Policy and Moroccan law.
5. Payment Processing
DWS processes payments on your behalf. You remain responsible for all transactions initiated through your account. All settlements are made in Moroccan Dirham (MAD) to your designated Moroccan bank account. Processing fees are agreed upon at account activation and are subject to the agreed pricing schedule.
6. Prohibited Activities
You may not use DWS services for: illegal activities or money laundering; fraudulent transactions or chargebacks; prohibited goods or services under Moroccan law; activities that violate Visa, Mastercard, or CMI network rules; any activity that poses a security risk to DWS or its users.
7. Security
You are responsible for maintaining the confidentiality of your API keys, dashboard credentials, and account information. You must immediately notify DWS of any unauthorized access or security breach. DWS implements PCI DSS Level 1 compliance and 3DS2 authentication on all transactions.
8. Limitation of Liability
DWS is not liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our liability is limited to the fees paid by you in the three months preceding the claim. DWS is not responsible for losses resulting from unauthorized access to your account due to your negligence.
9. Termination
Either party may terminate the merchant agreement with 30 days written notice. DWS may terminate or suspend your account immediately for material breach of these terms, fraudulent activity, regulatory requirements, or conduct that poses a risk to other merchants or customers. Outstanding settlements will be processed according to the settlement schedule.
10. Governing Law
These Terms of Service are governed by the laws of the Kingdom of Morocco. Any disputes shall be submitted to the competent courts of Casablanca, Morocco. DWS operations comply with Bank Al-Maghrib regulations and CNDP data protection requirements.
11. Changes to Terms
DWS reserves the right to update these Terms of Service. Significant changes will be communicated by email with 30 days notice. Continued use of our services after the effective date constitutes acceptance of the updated terms.
